Gogoro Network® Battery Service Agreement

Version: July 2025

This Gogoro Network® Smart Battery Service Agreement (hereinafter referred to as this “Agreement”) is entered into by and between the User (as defined in Article 1) and the Taiwan Branch of Ruineng New Power Co., Ltd. (hereinafter referred to as “Ruineng New Power”), a Cayman Islands-based company. After the User signs or agrees to the subscription documents (including but not limited to the purchase order, etc., hereinafter collectively referred to as the “Subscription Documents”), the User shall subscribe to the Gogoro Network® Smart Battery installation, replacement and charging services (hereinafter referred to as the “Battery Service”) from Ruineng New Power in accordance with the terms and conditions of this Agreement.

This contract only applies to the electric motorcycle purchased by the user from a third party cooperating with Ruineng New Power (the specific model is subject to the one stated in the purchase order, hereinafter referred to as the "subject of sale").

1. Battery service users

The user referred to in this contract is the buyer listed in the subscription document, or the successor of the subject matter of the sale who has completed the transfer registration with the supervisory authority and notified Rui Neng New Power. If the user changes his name, in addition to completing the name change registration with the supervisory authority, he should also notify Rui Neng New Power and complete the necessary procedures (including signing or agreeing to the necessary documents) according to Rui Neng New Power's instructions before he can subscribe and enjoy the battery service.

2. Battery Service Period

  1. The service period of this contract is 24 months from the date of activation of this contract. If the user purchases a brand new subject matter from a third party cooperating with Rui Neng New Power, the activation date is the date of delivery of the subject matter. If it is not the case as mentioned above, the activation date is the date of signing or agreeing to the subscription document. Unless otherwise agreed by both parties, otherwise agreed in this contract, or there is an early termination of this contract, this contract will automatically terminate upon expiration.
  2. If the user does not return the Gogoro Network® Smart Battery to the designated location of Rui Neng New Power at the end of the service period or the early termination of this contract, unless the user has changed the Gogoro Network® Battery Service tariff plan (hereinafter referred to as the "Tariff Plan") in accordance with Article 4, Section 2 of this contract, Rui Neng New Power may determine that the user agrees to continue to subscribe to the battery service according to the Gogoro Network® Smart Battery Service Contract announced at the time of subscription, with a validity period of 1 month, each 1 month as a period, in accordance with the Gogoro Network® Smart Battery Service Contract announced at the time of subscription, and the same applies thereafter. However, if the user violates this contract during the service period, Rui Neng New Power may refuse the user to continue to subscribe to the battery service in accordance with the provisions of this contract.
  3. Notwithstanding the preceding paragraph, if the user continues to subscribe to the battery service in accordance with Paragraph 2 of this Article, and before the start of the next battery service, the tariff plan applicable to the user's current battery service is no longer a tariff plan provided by Rui Neng New Power, unless Rui Neng New Power agrees to continue to apply the tariff plan to the next battery service, the user should choose another tariff plan from the tariff plans provided by Rui Neng New Power at that time; if the user does not make a choice, Rui Neng New Power may determine that the user agrees to continue to subscribe to the battery service in accordance with the tariff plan with the lowest basic fee among the tariff plans provided by Rui Neng New Power at that time and to subscribe to the Gogoro Network® Smart Battery Service Contract announced at that time, and the same applies thereafter.

3. Battery service range

  1. At the beginning of the service period of this contract, Smart Energy or its designated third party shall provide the user or its authorized person with the number of Gogoro Network® Smart Batteries required for the normal operation of the subject matter of the transaction.
  2. The User or his/her authorized person may (1) use and operate the battery service provided by Gogoro at any GoStation® battery swap station announced by Gogoro at any time during the operating hours of the GoStation® battery swap station, and/or (2) use and operate the battery service provided by Gogoro at his/her own expense using a GoCharger® Mobile on-board battery charger and/or other charging devices certified by Gogoro and approved for use by the User or his/her authorized person (hereinafter collectively referred to as "Gogoro® Charger").
  3. Unless otherwise agreed upon in this Agreement, otherwise agreed upon by both parties, and/or Rui Neng New Power or its designated third party has otherwise announced that the Gogoro Network® Smart Battery Compensation Exemption Plan in Appendix 1 is not applicable, users can enjoy the Gogoro Network® Smart Battery Compensation Exemption Plan in Appendix 1 for free during the service period. If the Gogoro Network® Smart Battery Compensation Exemption Plan is met, users do not need to bear compensation liability in accordance with Article 11 of this Agreement. The Gogoro Network® Smart Battery Compensation Exemption Plan will be suspended, shortened or terminated along with this Agreement.

IV. Service Fees

  1. When signing or agreeing to the subscription document, the user shall select one of the tariff plans offered by Rui Neng New Power to the user at that time, and the service fee (as defined below) shall be calculated from the activation date of the service period of this contract.
  2. Unless otherwise agreed by both parties (for example, the user agrees to bind the plan period), the user may notify Rui Neng New Power at any time during the service period to change the tariff plan to other tariff plans provided by Rui Neng New Power for the user to choose at that time, and the changed tariff plan will be applied to the remaining service period from the next billing cycle after the notification of the change. Rui Neng New Power reserves the right to suspend, cancel or change the existing tariff plan or its content and add other tariff plans.
  3. Unless otherwise agreed by both parties, the user shall pay the basic fees and additional fees (hereinafter referred to as "Service Fees") stated in the bill to the account designated by Rui Neng New Power in accordance with the payment method stated in the bill before the payment deadline stated in the bill, based on the tariff plan purchased by the user and the additional mileage or additional battery usage generated.
  4. The calculation of the riding mileage (including the basic mileage of the selected tariff plan and the additional mileage generated) and/or battery usage for each period is based on the date when the user (1) exchanges the battery at a GoStation® battery swap station and/or (2) charges the battery using a Gogoro® charger. Rui Neng New Power's internal records are updated after the Gogoro Network® smart battery (1) is exchanged at a GoStation® battery swap station or (2) is charged using a Gogoro® charger. If the riding mileage and/or battery usage displayed on the Gogoro® App, Gogoro Network® App or GoStation® battery swap station are inconsistent with Rui Neng New Power's internal records or determinations, the calculation of the service fee shall be based on Rui Neng New Power's internal records or determinations. For example: A user's billing cycle is from the 1st of each month to the end of that month. During that billing cycle (March 1 to March 31), if (1) the user's last battery swap at a GoStation® battery swap station (or charging with a Gogoro® charger) was on March 30, and the total mileage recorded by Rui Neng New Power was 95 kilometers; and (2) the user rode the subject of the transaction for 10 kilometers after swapping or charging the battery, and swapped the battery (or charged) on April 1, then the bill will be calculated based on the 95-kilometer mileage and the user will be charged the service fee for that period; the 10 kilometers used on March 31 will be included in the calculation of the riding mileage of the next billing cycle (i.e., April 1 to April 30), and the user will be charged the service fee.
  5. If the riding mileage or battery usage records are inconsistent with the actual usage due to no action by Rui Neng New Power, Rui Neng New Power may still charge the user for the service.
  6. The basic mileage or battery usage discount of the tariff plan is limited to the billing period of the bill. Unless otherwise specified in the tariff plan selected by the user, the basic mileage or battery usage discount that has not been used before the end of the billing period will be deemed expired and cannot be used in the next month.
  7. The user acknowledges and agrees that when signing this contract, Rui Neng New Power will charge a "system activation fee" to each purchase and sale subject according to the amount announced at that time (the fee is subject to the official website announcement https://network-support.gogoro.com/tw/ ). The user shall not require Rui Neng New Power to reduce, offset or refund the fee for any reason, including but not limited to the assignment, termination or termination of the contract. In accordance with the provisions of Article 14, Paragraph 2 of this contract, the rights and obligations of this contract shall not be transferred. In the event of the sale, assignment, transfer or similar circumstances of the purchase and sale subject, the successor of the purchase and sale subject shall re-sign the Gogoro Network® Smart Battery Service Contract and shall re-pay the "system activation fee" according to the amount announced at that time.

V. Battery Ownership

The user is aware that Rui Neng New Power is the sole owner of the Gogoro Network® Smart Battery and the user does not have ownership, other property rights, intellectual property rights or any other rights to the Gogoro Network® Smart Battery. In addition to the right to use the Gogoro Network® Smart Battery in accordance with this Agreement, the user shall not claim or exercise ownership, lien, other property rights or any rights to the Gogoro Network® Smart Battery, and the user has no right to transfer any rights or interests in the Gogoro Network® Smart Battery to any third party.

VI. User Obligations

Unless otherwise agreed by both parties, the User shall have the following obligations under this Agreement:

  1. The user shall take good care of the Gogoro Network® Smart Battery and abide by the Gogoro Network® Smart Battery Safekeeping Rules in Appendix 2. If the user gives the Gogoro Network® Smart Battery to an authorized person for possession or use, the user shall also require the authorized person to abide by the Gogoro Network® Smart Battery Safekeeping Rules in Appendix 2 and the provisions of this Agreement.
  2. Users are not allowed to disassemble or repair the Gogoro Network® Smart Battery or any part thereof, or allow others to do so, or take the Gogoro Network® Smart Battery out of countries or regions outside of Taiwan, Penghu, Kinmen, and Matsu.
  3. Users shall respect the intellectual property rights and trade secrets of Gogoro Network® Smart Battery and shall not engage in any behavior that infringes or may infringe upon such intellectual property rights or trade secrets.
  4. If any third party claims any rights to the Gogoro Network® Smart Battery or any part thereof, the user shall immediately notify Smart Power in writing. No action shall be taken without Smart Power's written instructions.
  5. Upon expiration of the service period or early termination of this contract, if Rui Neng New Power does not intend to continue to provide battery services to users, users do not intend to continue to use battery services, or users are suspended from battery services by Rui Neng New Power for more than 7 days, users must return the Gogoro Network® Smart Battery to the location designated by Rui Neng New Power within 7 days at the latest, and may not refuse, hinder or delay for any reason or in any way. In the event of a delay, Rui Neng New Power may directly retrieve the Gogoro Network® Smart Battery from the user or a third party at any time.
  6. Users should replace or charge the battery at least once every 30 days. If the dashboard of the trading target shows that the battery level of the Gogoro Network® Smart Battery is "zero", the user should immediately replace or charge the battery within 24 hours or when the trading target is next activated (whichever comes earlier). If there is any violation, in addition to being liable for damages in accordance with this contract, the user expressly agrees that Rui Neng New Power may directly retrieve the Gogoro Network® Smart Battery from the user or a third party at any time. However, this contract will not be suspended for this reason, and the service period will not be extended for this reason. Users can contact Rui Neng New Power to retrieve the Gogoro Network® Smart Battery.

VII. Suspension or interruption of battery service

  1. RuiNeng New Power may suspend all or part of the battery service due to the following reasons. Users shall not request RuiNeng New Power to bear any responsibility for this, and the service period of this contract shall not be extended accordingly:
    1. Maintain, relocate, upgrade or service the battery service system.
    2. Causes that cannot be attributed to Rui Neng New Power, such as natural disasters, power outages, equipment failures, abnormal operations, or the actions of a third party.
  2. Users may suspend the use of battery services at any time, but the service period of this contract will not be extended as a result. The battery service suspension period will be calculated from the day after the user returns the Gogoro Network® Smart Battery to the location designated by Rui Neng New Power (hereinafter referred to as the "Suspension Base Date"), and the user will be exempt from paying service fees from the Suspension Base Date to the end of the battery service suspension period. The suspension period for each battery service suspension applied by the user must be at least 30 days (inclusive) and shall not exceed 90 days (hereinafter referred to as the "Suspension Period"). In each calendar year from the date of activation of the battery service, the cumulative number of suspension days for which the user applies to suspend the battery service shall not exceed 90 days in total; if the suspension period expires and no extension is applied for or the suspension period exceeds 90 days in total, the user shall still pay the service fee of the tariff plan.
  3. If the user finds that the subject of the transaction or the Gogoro Network® Smart Battery has failed to function, been damaged, or has reduced in value or utility, or other damage other than natural wear and tear caused by normal use (hereinafter referred to as "damage"), or has been lost, stolen or destroyed (hereinafter referred to as "theft"), or has been seized, the user shall immediately notify Rui Neng New Power by phone or in writing, and at the same time provide a copy of the three-part report form (if it is lost or stolen) or photos or declaration documents sufficient to prove the above situation, so as to suspend the use of the battery service, and cooperate with Rui Neng New Power to carry out relevant procedures (regardless of whether the Rui Neng New Power Gogoro Network® Smart Battery Compensation Waiver Plan in Appendix 1 is applicable), including but not limited to signing relevant documents. The user shall be exempted from paying the service fee from the completion of the above procedures until the end of the suspension period of the battery service; however, the service period of this contract shall not be extended accordingly.

8. Termination of this Agreement

  1. If any of the following circumstances occur, Smart Energy will notify the user of the circumstances and may suspend battery service, shorten the service period, cancel part of the benefits of this contract, or terminate the application of this contract depending on the severity of the circumstances:
    1. The user violates Article 6 of this Agreement;
    2. The user violates the agreement or contract with Rui Neng New Power, or fails to pay the full bill on time;
    3. The subject of the User's transaction has been lost, stolen, disabled, damaged, destroyed, or seized;
    4. The Gogoro Network® Smart Battery has been lost, stolen, disabled, destroyed, or impounded;
    5. There are objective circumstances sufficient to prove that the user has used the subject matter of the transaction or this contract to engage in illegal activities;
    6. If there is any litigation or other similar situation due to the ownership of the subject matter of the sale;
    7. When a third party notifies you that they will exercise a lien on the vehicle carrying the Gogoro Network® Smart Battery; or
    8. Other circumstances that are reasonably determined by Rui Neng New Power to be attributable to the user and require the suspension of battery service, shortening of service period, cancellation of part of the benefits of this contract, or termination of this contract.
  2. If the measures taken by Rui Neng New Power due to the first issue cause any loss or damage to the user, Rui Neng New Power will not be responsible for such loss or damage.
  3. The suspension of battery service by Ruineng New Power in accordance with the notice in Item 1 shall not extend the service period of this contract.
  4. When the sales contract for the subject matter of the sale is terminated, Rui Neng New Power may also terminate or cancel this contract.

IX. Disclaimer

  1. Smart Energy only provides battery services based on the functionality and current status of the Gogoro Network® Smart Battery at the time of provision. To the maximum extent permitted by law, Smart Energy expressly excludes or disclaims any representations, warranties and promises, including but not limited to representations, warranties or promises related to accuracy, reliability, satisfaction, quality, fitness for a particular purpose and non-infringement.
  2. Except for intent or gross negligence, Ruineng New Power shall not be liable for damages for battery services to the maximum extent permitted by law.

10. Changes to this Agreement

  1. The user understands and agrees that Rui Neng New Power may modify or change the contents of this contract (including transferring this contract to its affiliated companies in accordance with Article 14, Paragraph 2 of this contract), but Rui Neng New Power will notify the user separately or together with the bill or by announcement 30 days before the modification or change takes effect.
  2. The user agrees to sign or stamp with an electronic signature or other electronic tools or methods. Documents signed or stamped in the aforementioned manner shall be deemed to be the original signed or stamped documents, and shall have the same effect as signing or stamping on paper. This agreement and its annexes, as well as their amendments, supplements, changes or terminations, may also be signed in electronic documents, and shall have the same effect as those signed in paper documents.

11. Indemnification

  1. If the Gogoro Network® Smart Battery is damaged, stolen, or seized for any reason, including but not limited to the User’s violation of the provisions of this Agreement, the User shall immediately notify Rui Neng New Power. Except for the circumstances stipulated in Article 3, Paragraph 3 of this Agreement, the User shall also compensate for the Gogoro Network® Smart Battery in accordance with the Gogoro Network® Smart Battery Compensation Standard in Appendix 3, and the Gogoro Network® Smart Battery shall still belong to Rui Neng New Power after the User’s compensation.
  2. If the user disassembles the Gogoro Network® Smart Battery by himself or through others, he/she will be held criminally liable for crimes such as damage under the Criminal Law of the Republic of China. In addition to paying compensation in accordance with the Gogoro Network® Smart Battery Compensation Standard in Appendix 3, the user must also pay 100 times the replacement cost of the Gogoro Network® Smart Battery to Rui Neng New Power as punitive liquidated damages.
  3. If the user takes the Gogoro Network® Smart Battery out of Taiwan, Penghu, Kinmen, and Matsu by himself or through others, he/she shall pay 100 times the replacement cost of the Gogoro Network® Smart Battery to Rui Neng New Power as punitive liquidated damages.
  4. If the user violates the provisions of this contract and Zhiruineng New Power needs to conduct additional inspections or disposal of the Gogoro Network® Smart Battery, all related costs incurred (including but not limited to labor costs, logistics costs, functional testing costs, etc.) shall be borne by the user.

12. Applicable Law

This Agreement shall be interpreted and applied in accordance with the laws and regulations of the Republic of China. If the parties cannot resolve any disputes between the user and Rui Neng New Power regarding this Agreement through friendly negotiation, both parties agree that the Taipei District Court of Taiwan shall be the exclusive jurisdiction court of the first instance.

13. Notice

  1. Unless otherwise agreed by both parties, Rui Neng New Power may choose to make notifications under this contract by registered mail, telephone or email. Unless the user subsequently notifies changes in a manner permitted by Rui Neng New Power, the above notification method shall be based on the communication address, telephone number and e-mail provided by the user, or the communication address, telephone number and e-mail provided by the successor of the subject matter of the sale when notifying Rui Neng New Power.
  2. The user understands and agrees that, unless otherwise agreed by both parties, Rui Neng New Power may send electronic bills for service fees by email, and will not mail paper bills separately. The user understands and agrees that after Rui Neng New Power sends out electronic bills, if the following circumstances occur, it will still be deemed to have been delivered, and if the user suffers any loss or damage, Rui Neng New Power will not be responsible for such loss or damage; the user may apply to Rui Neng New Power in writing for the reissue of electronic bills for the last three billing cycles:
    1. Due to insufficient space in the user's email mailbox, the Smart Energy New Energy electronic bill cannot be transmitted or is delayed in receipt;
    2. Due to the settings of the company providing the user's email mailbox service, the Rui Neng New Power electronic bill cannot be transmitted or is delayed in receipt, or is classified as junk or advertising mail;
    3. The company providing the user's email mailbox service has an abnormality, resulting in the inability to complete the transmission of the Ruineng New Power electronic bill or delayed receipt;
    4. Other reasons not attributable to Ruineng New Power that result in the inability to complete the transmission of Ruineng New Power's electronic bills or delayed receipt.
  3. The user understands and agrees that if the user subscribes to other ongoing or one-time services or products other than battery services from Rui Neng New Power (including but not limited to performance improvement services, and not limited to services or products currently subscribed by the user) or subscribes to other ongoing or one-time services or products provided by a third party through Rui Neng New Power, Rui Neng New Power may combine the service fees and the fees or prices incurred by other services or products (hereinafter referred to as "other fees") into the same bill; in this case, the user agrees not to request Rui Neng New Power to bill the service fees and other fees separately.

XIV. Other matters

  1. The user understands and agrees that this contract does not cover all the contents and restrictions of the tariff plan. If there are any details not set out in this contract, the user agrees to comply with the subscription documents or other documents stating the contents and restrictions of the tariff plan.
  2. The user understands and agrees that, without the prior written consent of Rui Neng New Power, the user shall not transfer part or all of the rights or obligations under this contract to a third party, but Rui Neng New Power may transfer all or part of this contract to its affiliated companies.
  3. If any one or more of the terms of this Agreement are deemed invalid, illegal or unenforceable, such invalidity, illegality or unenforceability shall not affect the other terms of this Agreement.
  4. This contract is the sole and complete agreement between the two parties regarding battery services, and its effectiveness supersedes any previous oral or written agreements.

Appendix 1 Gogoro Network® Smart Battery Compensation Waiver Plan

Exemption scope

  1. During the validity period of the Gogoro Network® Smart Battery Compensation Waiver (hereinafter referred to as the "Waiver"), users enjoy the following rights:
    If the Gogoro Network® Smart Battery is damaged or stolen, the user is exempted from the liability for compensation according to the Gogoro Network® Smart Battery Compensation Standard. However, if the exceptions specified in this Waiver occur, the user still needs to bear the liability for compensation according to the Gogoro Network® Smart Battery Compensation Standard in Appendix 3.
  2. The Gogoro Network® Smart Battery liability exemption enjoyed by the user under this exemption is limited to the Gogoro Network® Smart Battery itself used by the user at the time, and the total number is capped at 2.

Exceptions

If any of the following circumstances occur, the user must still bear the compensation liability according to the Gogoro Network® Smart Battery Compensation Standard:

  1. Caused by the following actions or circumstances:
    1. The user or the person authorized by the user fails to comply with the storage requirements of the Gogoro Network® Smart Battery Storage Rules in Appendix 2.
    2. The User or the person authorized by the User violates any of the provisions of Article 6, Paragraphs (2), (3), (5), and (6) of this Agreement.
    3. The user or the person authorized by him/her has an excessive alcohol concentration or has taken drugs, narcotics or the like, constituting an inability to drive safely as stipulated in traffic regulations, but still rides the subject of sale.
    4. Intentional acts of the user or his/her authorized person.
    5. The user or the person authorized by the user commits an intentional crime, or the user uses the subject of the transaction as a tool for criminal behavior.
    6. The user or the person authorized by the user uses the subject of the transaction for racing or driving training purposes.
    7. The user or the person authorized by him/her violates traffic regulations.
    8. Other actions that are deemed by Smart Energy to be abnormal use of the Gogoro Network® Smart Battery.
  2. Failure to fulfill the following obligations:
    1. The user or his/her authorized person fails to notify Smart Power immediately upon discovery that the Gogoro Network® Smart Battery is damaged or stolen.
    2. The user fails to complete the Gogoro Network® Smart Battery compensation exemption procedure and return the Gogoro Network® Smart Battery to Smart Power within 7 days after the Gogoro Network® Smart Battery is damaged.
    3. The user fails to complete the Gogoro Network® Smart Battery compensation exemption procedure within 7 days after the Gogoro Network® Smart Battery is stolen, provide a copy of the police report and other documents that Smart Power believes are sufficient to prove the theft of the Gogoro Network® Smart Battery, and sign the document required by Smart Power to certify that the Gogoro Network® Smart Battery has been stolen and cannot be returned.

Appendix 2 Gogoro Network® Smart Battery Storage Rules

Safekeeping matters

Users should keep the Gogoro Network® Smart Battery in the following manner:

  1. Do not store the Gogoro Network® Smart Battery in high temperature locations or expose the Gogoro Network® Smart Battery to direct sunlight for more than 30 minutes.
  2. It is strictly forbidden to use the Gogoro Network® Smart Battery for purposes not approved by Rui Neng New Power. Please keep the bottom connection port of the Gogoro Network® Smart Battery clean and free of foreign objects. It is strictly forbidden to use metal objects to contact or short-circuit the bottom connection port of the Gogoro Network® Smart Battery.
  3. It is strictly prohibited to place the Gogoro Network® Smart Battery into fire, heat, cool, immerse in water, drop or knock it, or attempt to disassemble or damage it.
  4. It is strictly prohibited to disassemble or change the appearance or structure of the Gogoro Network® Smart Battery.
  5. It is strictly prohibited to use methods and/or equipment not officially approved by Gogoro to charge or discharge the Gogoro Network® Smart Battery.
  6. Do not use any solvents or chemicals on the Gogoro Network® Smart Battery.
  7. Do not store or stack any items in the space between the Gogoro Network® Smart Battery handle and the Gogoro Network® Smart Battery cover.
  8. It is strictly prohibited to temporarily or permanently change the shape or appearance of the Gogoro Network® Smart Battery by any means or techniques, including but not limited to sticking, painting or laser engraving.
  9. The Gogoro Network® Smart Battery should be kept and stored in an upright position.
  10. It is strictly forbidden to discard the Gogoro Network® Smart Battery. If there is a faulty Gogoro Network® Smart Battery, please contact Ruineng New Power for assistance.

Reminders

Users are kindly reminded to pay attention to the following matters when storing the Gogoro Network® Smart Battery:

  1. The Gogoro Network® Smart Battery may become slightly hot after use. Please be careful when replacing or handling the battery.
  2. Each Gogoro Network® Smart Battery weighs approximately 9.8 kg. Please handle and place with care.
  3. If there is any abnormality with the Gogoro Network® Smart Battery (such as leakage, damage, deformation, etc.), please stop using the Gogoro Network® Smart Battery and the Trading Target immediately, please immediately put the Trading Target into "motor off state" and lock it, and contact Rui Neng New Power for assistance.

Other matters

Smart Energy may modify or supplement the Gogoro Network® Smart Battery storage rules at any time and notify users separately or together with bills or through announcements.

Appendix III Gogoro Network® Smart Battery Compensation Standards

Gogoro Network® Smart Battery

  1. The Gogoro Network® Smart Battery is a precision-designed product with associated protection measures. In addition to the natural wear and tear caused by normal use, if the user abides by the Gogoro Network® Smart Battery Storage Rules in Appendix 2, the Gogoro Network® Smart Battery will not malfunction.
  2. If the Gogoro Network® Smart Battery is damaged, stolen, or seized, or the value or normal utility of the Gogoro Network® Smart Battery is reduced due to any reasons other than natural wear and tear caused by normal use, including but not limited to the user's violation of the provisions described in the preceding paragraph, SmartPower will need to update and reset the Gogoro Network® Smart Battery and will not be able to continue using the Gogoro Network® Smart Battery by repairing or restoring it.

Responsibility Judgment

  1. If the Gogoro Network® Smart Battery is damaged, stolen, or seized, the user shall bear the liability for compensation.
  2. If the Gogoro Network® Smart Battery fails in all or part of its functions, or reduces the value of the Gogoro Network® Smart Battery or its normal utility: Smart Power will make a liability judgment and determine the responsibility according to the judgment result. If there is no judgment, the user does not need to bear the compensation liability.

Principles of compensation

  1. The user fully understands and agrees that the replacement cost of the Gogoro Network® Smart Battery may increase or decrease due to relevant factors, including but not limited to the purchase and sale prices of the Gogoro Network® Smart Battery raw materials and components, transportation costs, labor costs, exchange rate fluctuations, etc. The replacement cost amount provided in this compensation standard is the current replacement cost of the Gogoro Network® Smart Battery and is for user reference only. Rui Neng New Power may modify the replacement cost of the Gogoro Network® Smart Battery at any time and notify the user separately or together with the bill or by announcement.
  2. The user fully understands and agrees that if the liability is determined to be the user's responsibility, the user must pay the replacement cost of the Gogoro Network® Smart Battery at that time.
  3. The replacement cost of each Gogoro Network® Smart Battery is currently NT$25,000.
